Road Construction Consent

As the roads authority for their area, The City Edinburgh Council require that anyone wishing to construct a new road or extend an existing road must obtain Road Construction Consent in accordance with Section 21 of the Roads (Scotland) Act 1984.

The Development Control team in the Transport Division of City Development are responsible for dealing with all aspects of the Road Construction Consent process from the application stage right through to the adoption stage. The team can offer advice on specification and design standards. The team will also carry out inspections of the new roads during the construction process and prior to adding the new roads onto the List of Public Roads.

If the Road Construction Consent is associated with a private housing development then the developer must provide security in accordance with Section 17 of the Roads (Scotland) Act 1984 and the Security for Private Road Works (Scotland) Regulations 1985 (as amended 1998). Normally the security will be lodged in the form of a Road Bond although cash bonds are also accepted.

The team are currently reviewing their policy and design guidance documentation and it is expected that this will be available in a downloadable format later in the year. Interim specifications for road construction and traffic signals are included below.

Any works on existing roads associated with a development require separate authorisation, and a permit giving consent for such works, from the relevant local area roads manager in the Council’s Services for Communities Department.
